That Halifax Regional Council approve an increase to the contract with Strum Environmental Ltd. (PO 2070837986) in the amount of $30,000 (net HST included) with funding from CP200002 Halifax Common Upgrades as outlined in the Financial Implications section of the staff report dated September 29, 2022.

15.1.2 Award – Province of Nova Scotia Request For Proposal (RFP) Doc767243048, Supply and Delivery of Furnace Oil, Propane, Jet Fuel, Diesel and Gasoline - REVISED* [PDF]
Motion:
That Halifax Regional Council: 

1. Approve the standing offer agreement related to the Province of Nova Scotia’s RFP Doc767243048 for Heating Fuel/Propane/Jet Fuel/Diesel/Gasoline, to Highland Fuel Delivery G.P./ Irving Oil Commercial G.P o/a Irving Energy for the furnace oil, diesel fuel, propane and gasoline for a three (3) year period ending August 31, 2025 with the option to renew annually for two (2) additional one year terms for the approximate total three (3) year spend of $42,000,000 and $28,000,000 for the two (2) option years. This will result in an approximate $14,000,000 per year spend with funding as outlined in the Financial Implications section of the staff report dated October 31, 2022.

2. Direct the Chief Administrative Officer (CAO) to execute the services contract with terms and conditions acceptable to the CAO and subject to review and approval as to form and authority by Legal Services.

15.1.3 Student Transit Pass Pilot Program - Phases 2 & 3* [PDF]

That Halifax Regional Council:

1. Approve the implementation of Phase 2 of the Student Transit Pass Pilot Program as outlined in the staff report dated November 8, 2022; and

2. Accept a contribution of $200,000 from Halifax Regional Centre for Education towards the pilot
program and authorize the Chief Administrative Officer to negotiate and execute a contribution agreement.

That Halifax Regional Council:

1. Adopt Administrative Order 2022-013-GOV, the CAO Selection Committee Administrative Order, as set out in Attachment 3 of the staff report dated November 4, 2022; and

1. Repeal Administrative Order #2020-004-ADM – the Procurement Policy; 

2. Repeal the Changes to Cost Sharing for Capital Projects Policy; 

3. Adopt Administrative Order 2022-012-ADM as set out in Attachment 1 of the staff report dated November 14, 2022 to establish a new Procurement Policy for the Municipality. 

15.1.6 Sobering Centre Pilot [PDF]
Motion:
That Halifax Regional Council:

1. Approve implementation of a three-year Sobering Centre pilot, commencing this fiscal year, in partnership with the Nova Scotia Office of Addictions and Mental Health; 

2. For fiscal years 2023-2024, and 2024-2025, the continuation of the pilot project be conditional on Municipal and Provincial budget approval. Approve the allocation of up to $139,215 for a shared cost approach to a sobering centre pilot in 2022/23 with the Nova Scotia Office of Addictions and Mental Health, contingent on Provincial approval; and 

3. Approve an additional two-year allocation of $490,768 each year for a shared cost approach to ongoing operating costs of a sobering centre pilot with the Nova Scotia Office of Addictions and Mental Health, contingent on Provincial approval and Municipal budget approval. 

15.1.7 Case 23617: Review of the Upper Hammonds Plains Land Use Designation and the GU-1 Zone* [PDF]
Motion:
That Halifax Regional Council give First Reading to consider the proposed amendments to the Municipal Planning Strategy and Land Use By-law for Beaver Bank, Hammonds Plains, and Upper Sackville, as set out in Attachments A and B of the staff report dated November 17, 2022, to amend the Upper Hammonds Plains Designation and the GU-1 (General Use) Zone, and to rezone a portion of lands within the designation from the GU-1 Zone to the R-1 (Single Unit Dwelling) Zone, and schedule a public hearing.

15.1.8 Supplementary Information on the Municipal Design Guidelines [PDF]

That Halifax Regional Council:

1. Direct the Chief Administrative Officer to continue to update the Municipal Design Guidelines to meet industry best practice, as described in the November 9, 2021 Council Report dated June 16, 2021; and, 

2. Request the Mayor to write a letter to the Minister of Public Works requesting that the authority to set speed limits below 50 km/hr be delegated to the HRM Traffic Authority. 

15.1.9 Lived Experience Committee and Consultation [PDF]

That Halifax Regional Council direct the Chief Administrative Officer (CAO) to: 

1. continue to seek lived experience expertise from those living in encampments to guide municipal work to address homelessness and its impacts; and 

2. respond to the recommendations of the HRM Lived Experience Consultation Report with additional analysis as part of the broader report on HRM’s approach to homelessness which staff are preparing.

That Halifax Regional Council approve an increase to the Design Services component of RFP No. 18-370 (Detailed Design for Macdonald Bridge Bikeway Connectors Project) to WSP Canada Inc. (P.O. That Halifax Regional Council direct the Mayor to write to the Minister of Municipal Affairs, requesting that the power to develop, enter into and enforce Community Benefit Agreements be added to the HRM Charter, and that the Province work with the Municipality to do so.

That Halifax Regional Council adopt By-law U-112, amending By-law U-100, the User Charges By-law, as set out in Attachment D of the staff report dated September 8, 2022.

15.5 BOARD OF POLICE COMMISSIONERS
15.5.1 Committee of Council to Review the Subcommittee on Defunding the Police Report Recommendations [PDF]
Motion:
That Halifax Regional Council form a committee of Council to work on the recommendations of the Subcommittee on Defunding the Police report on de-tasking police:

1. The role of the Committee will be to review the report recommendations in line with the Working Group’s report and determine how each recommendation could be implemented.

2. The Membership of the Committee would include:
    a. Two Board of Police Commissioners members;
    b. Two HRM Councillors;
    c. Two representatives from HRM (CAO’s office, Public Safety Office, Social Policy, etc);
    d. Representative from the Province of Nova Scotia Department of Justice;
    e. Representative from Halifax Regional Police;
    f. Representative from Halifax District RCMP; and
    g. Four members at large from the community with relevant experience. 

3. The Committee will provide regular updates to the Board of Police Commissioners.

15.6 MEMBERS OF COUNCIL
15.6.1 Councillor Russell – Request a Letter to the Province to Amend the Halifax Regional Municipality Charter [PDF]
Motion:
That Halifax Regional Council:

1. waive section 17 of Administrative Order One, requiring a staff report from the Chief Administrative Officer; 

2. request the Mayor to write a letter to the province requesting an amendment to the Halifax Regional Municipality Charter to provide a retroactive change so the term of the Municipal Auditor General would be for a 10-year period.

15.6.2 Councillor Austin – Amendments to Allow Boardwalk Usage at 300 Prince Albert Road [PDF]
Motion:
That Halifax Regional Council direct the Chief Administrative Officer (CAO) to provide a staff report on amending the Regional Plan and/or The Regional Centre Municipal Planning Strategy and Land Use By-law to allow for a relaxation of the required watercourse setback at 300 Prince Albert Road to allow for the establishment of a boardwalk space via the appropriate planning process.

Motion:

That Halifax Regional Council direct the Chief Administrative Officer (CAO) to provide a staff report and return to Council with options to require construction projects to lessen impacts and risks to public safety due to prolonged public street closures. The report should include options to fine contractors for work in the right of way that extends well beyond the approved permit duration.

16.2 Mayor Mike Savage
Motion:

That Halifax Regional Council direct the Chief Administrative Officer to develop a strategy with the Halifax Partnership to proactively attract, house, and retain the skilled talent required to address our economy’s acute labour shortages, with a focus on skilled tradespeople and labourers needed by the construction industry for housing construction.
