Request
Application by Dexel Development Ltd., requesting non-substantive amendments to an existing development agreement, specifically Schedule D, Schedule B and the architectural appearance of the tower portion of a 30-storey mixed-use apartment building at 5970 Spring Garden Road, Halifax.
Proposal
The applicant is requesting non-substantive amendments to the existing development agreement which permits a mixed-use development consisting of two 30-storey towers situated over a shared podium with four levels of underground parking.
The proposed amendment includes the relocation of the pedestrian access to the residential portion of the development from its original location facing Spring Garden Road to the rear of the building. This modification will allow for the creation of a vehicle drop-off and pick-up area covered by a cantilevered section of the building.
Additionally, the applicant is proposing one additional level of underground parking, along with additional access to the underground parking levels from Spring Garden Road. This entrance to the underground parking is intended to reduce congestion on Carlton Street by providing an alternative route for vehicles to access the underground parking.
Also, proposed changes to the architectural appearance of the building are included in the amendment request. This includes the addition of residential balconies on both towers to accommodate “mini split” HVAC units for the residential units.
The major aspects of the proposal are as follows:
- An additional vehicle entrance from Spring Garden Road;
- One additional level of underground parking;
- The addition of exterior balconies on the tower portions of the building to allow for the optimization of the HVAC system by accommodating the exterior compressor for 1:1 min-split heat pumps; and
- The addition of a resident drop-off and pickup at the rear of the building.
The approved development agreement (provided below) outlines the development proposal in detail, and regulates the lands related to:
- Allows for two (2), 30 storey residential towers over a common podium at the corner of Spring Garden Road and Robie Street in Halifax;
- Permit the tower portion of the building to be no higher than 90m (295 feet);
- Include a minimum 600 square meters of indoor amenity space and 200 square meters of outdoor amenity space on level 4 of the podium;
- Provide vehicle and bicycle parking pursuant to those applicable sections of the Regional Centre Land Use Bylaw; and
- Include ground floor retail uses along Spring Garden Road and Robie Street.
Process
The application will be considered under the non-substantive amendments to a development agreement application process.
Status
The application is now being reviewed by municipal staff, and it has been determined that no further public engagement is required. A staff report will soon be drafted and forwarded to the Development Officer for review and a decision.
