ZZap Consulting Inc. is applying to amend the Halifax Municipal Planning Strategy and Halifax Mainland Land Use By-law. The applicant wishes to construct a four (4) storey apartment building at 44, 44B, 46, and 48 Main Avenue, Halifax.

Proposal

The proposal includes changing the zoning of the subject site at 44, 44B, 46, and 48 Main Avenue, Halifax, from R-2P (General Residential) Zone to C-2C (Dutch Village Road Mixed Use) Zone to allow for the construction of a four-storey apartment building facing Main Avenue.

The applicant has provided concept drawings that illustrate how the property could be redeveloped under the C-2C Zone requirements and with the requested changes proposed under the HAF amendments. The proposal would also include site-specific amendments to the LUB requirements that would:
•    limit commercial uses to the ground floor of the building, and 
•    require a side yard landscape requirement that includes fencing and a 3-metre landscaped area.

Expanded Study Area: 50A, 50B, 52, 54, 58 Main Avenue, Halifax

As part of this application, Regional Council directed staff to include this expanded study area in the review. These five properties (50 to 58 Main Avenue) are proposed to be rezoned from R-2P (General Residential) Zone and R-2AM (General Residential Conversion) Zone to C-2C (Dutch Village Road Mixed Use) Zone.

The proposed rezoning would permit the existing uses and would allow these properties to be used for any use permitted in the C-2C Zone. Development of these properties would be subject to the requirements of the C-2C Zone of the Halifax Mainland Land Use By-law (insert link to by-law: https://www.halifax.ca/about-halifax/regional-community-planning/community-plan-areas/halifax-plan-area.)

The application will be considered under the MPS Amendment and Land Use By-law Amendment Process.

On December 13, 2022, Halifax Regional Council directed staff to begin this planning process. View the initiation report here

On September 26, 2023, Regional Council directed the CAO to expedite amendments to planning documents to support key Housing Accelerator Fund (HAF) initiatives. In collaboration with the federal and provincial governments, as part of the continued effort to support housing supply, the municipality is proposing amendments to planning documents throughout Halifax Regional Municipality.

Planning Case MPSA-2023-00484 has been incorporated into the proposed Housing Accelerator Fund (HAF) amendments.
